Activity also softened in the Philadelphia, St. Louis, Minneapolis, and San Francisco regions, the latter of which attributing part of the weakness to “severe weather.”Meanwhile, home prices maintained their upward trend across most of the country, with only Boston reporting slight pullback in prices of single-family homes.Mortgage lending activity was similarly mixed. The Fed observed increases in residential real estate lending in the regions of Chicago, Kansas City, and Dallas, while activity held steady in Atlanta and San Francisco. On the other hand, Cleveland saw a slight weakening in lending, as did Richmond, thanks to a decline in refinancing. January 27, 2016 2,275 Views In December, President Obama signed into law the omnibus bill that included a provision allowing homeowners to exclude forgiven mortgage debt from their gross income when filing federal tax returns.More than a month later, California State Senator Cathleen Galgiani (D-Stockton) has introduced a bill that would extend tax relief on forgiven mortgage debt for homeowners when filing their state income tax returns. Senate Bill 907 would allow California homeowners who have either sold their home in a short sale or received some type of forbearance on their mortgage payments to exclude forgiven or cancelled mortgage debt from their state income tax forms when listing their income. Without legislation, both the California state and federal government would require homeowners to list cancelled mortgage debt as income.California has been one of the states hardest hit by the housing crisis. In January 2009, distressed residential property sales in the state peaked at 67 percent—meaning REO sales and short sales accounted for approximately two-thirds of all residential home sales in the state during the month, according to data released by CoreLogic on Tuesday. By November 2015, the distressed sales share had fallen to slightly more than 8 percent in California, according to CoreLogic—but the state still ranked fourth in completed foreclosures for the 12-month period ending in November 2015 with 24,000. Not only that, but financial troubles have still persisted in the state. For example, in 2015, more than 80,000 consumers filed for bankruptcy in the state of California—tops among states and more than 24,000 more than second-place Illinois, according to AACER bankruptcy data reported by Epiq Systems.Galgiani’s bill would provide much-needed state income tax relief to borrowers who cannot afford to pay taxes on money which was counted as income but money that they never actually received.“This is a common-sense measure to avoid additional fiscal burdens on those who are facing financial uncertainty as a result of the economic crisis and often unemployment,” said Galgiani. “Taxpayers who have lost their homes could face an additional income tax liability of thousands of dollars or more.”The exclusion of forgiven mortgage debt provision for federal income tax that was signed into law by President Obama in December is an extension of the Mortgage Forgiveness Debt Relief Act of 2007, originally signed into law by President George W. Bush. The original act relieved distressed homeowners from having to pay taxes on forgiven mortgage debt for the three calendar years of 2007 through 2009. That tax exemption was extended three more years until the end of 2012 with the Emergency Economic Stabilization Act of 2008, and it was extended until the end of 2013 with the American Taxpayer Relief Act of 2012. In December 2014, president Obama extended the tax exemption for forgiven mortgage debt until the end of 2014. Last month, it was extended until the end of 2017.“We want to make sure that families who are trying to stay on their feet aren’t kicked while they are down,” said U.S. Rep. This is largely due to the plastic bag bans adopted by Lacey, Olympia, Tumwater, and the unincorporated areas of Thurston County in 2014.The Solid Waste Division of the Public Works Department conducted a waste sort shortly after the ban took effect last year. A 53% decrease was seen even while some stores and residents were using up supplies they had. “The main reason for the ban was the negative environmental impacts of the approximately 90 million single-use plastic shopping bags used in Thurston County each year. So that large of a decrease, that quickly, shows it is working,” said Terri Thomas, Waste Reduction Specialist with Thurston County.Six months into the ban, Thurston County Solid Waste conducted a survey soliciting feedback of residents and local businesses and has now posted those results online. “We were glad to see that over 7,300 residents took the survey but disappointed that we received only 65 business responses,” said Thomas. The countywide survey results, with comments, is 819 pages so best read online. The results are also broken down by jurisdiction. Only 3% of residents report carrying out their purchases in single-use plastic bags as opposed to 63% before the ban. Use of reusable bags has gone from 20% to 53%. Forty-six percent of the residents and 51% of verified businesses that took the survey feel the ban should be kept in place or expanded to other jurisdictions.The Solid Waste Division will conduct another survey of residents and businesses on the plastic bag ban ordinance in July 2016. Following up on my comments on green product verification – One More Thing to Worry About– I recently learned about ICC ES-SAVE (Sustainable Attributes Verification and Evaluation), yet another program to verify the sustainability of products.While still new, at first glance, this program appears to get it right. They have rigorous criteria, including on-site inspections of factories, providing end users with assurance that a company’s claims of sustainability are true. Their goal is to provide “technically accurate product information that can be helpful to those seeking to qualify for points under major green rating systems (U.S. Green Building Council’s LEED, Green Building Initiative’s (GBI) Green Globes, or the proposed National Green Building Standardâ„¢).”Nine Faces of SustainabilitySAVE has nine criteria under which products can be certified:• Biobased Material Content• Solar Reflectance, Thermal Emittance And Solar Reflective Index Of Roof Covering Materials• Regionally Extracted, Harvested Or Manufactured Materials Or Products• Volatile Organic Compound (Voc) Content And Emissions Of Adhesives And Sealants• Volatile Organic Compound (Voc) Content And Emissions Of Paints And Coatings• Volatile Organic Compound (Voc) Content And Emissions Of Floor Covering Products• Formaldehyde Emissions Of Composite Wood And Engineered Wood Products• Certified Wood And Certified Wood Content In ProductsProducts that meet their criteria are issued a Verification of Attributes Report or VAR (they seem to be slightly acronym obsessed, but I’ll forgive them), confirming that their claims are true. The first, and thus far only, VAR issued is for bio based content in the new Icynene spray foam. It is short and sweet, simply stating the fact that they have 8% bio based content in their product (with +/- 3% variation – is that 3% of 8% or 3% of 100%? I could use an explanation).Washing our Hands of GreenwashingCertifying buildings under the various green programs thus far has relied on manufacturer’s statements that products meet the various requirements for recycled, local, bio-based content, and other related criteria. This method, with little if any oversight, is wide-open to greenwashing. By providing independent third-party verification, the ICC should raise the bar for all programs, eventually eliminating the potential for incorrect or unsubstantiated claims. It should also help provide credibility that some of the industry created and managed programs may lack. As this program develops, we may see program points for sustainable products requiring ICC-SAVE, or equivalent, certification.Marking Their TerritoryI am sure that there will be plenty of fussing over which certification is better, or even acceptable. It would be a shame if every “certification” program is accepted by all the green building programs. It is likely, however, that the more rigorous programs will accept only a higher level third-party certification, while others will be less restrictive. Just as we are seeing NAHB, LEED, Energy Star, and other local and regional programs out there marking their territory, I expect that the various product certifications will do the same. Think dogs and fire hydrants. It will be interesting to watch.
